A recent judgment in the High Court of Van Zyl vs The Road Accident Fund by Judge Satchwell has a lot of attorneys breathing a sign of relief. The judgment held that in terms of the new Act attorneys get five years to lodge a serious injury case, so long as the Form 1 was lodged within the three years allowed by the Act.
It is so important for members of the public to realise that they really do have to act with some haste in going to see an attorney, also to assist with the recovery of evidence, and to ensure that the claim is lodged within the three year period. Attorneys now have the benefit, if the claim is lodged within the three year period, of knowing that they have five years to complete the serious injury form, from the date of the accident, and have it lodged if money is being claimed for a serious injury. That's great news. I'll advise all claimants to rather work through an attorney cause handling the claim on your own is hell. I wish we could have such a firm like yours in the Western Cape.

I think this was a good decision. I think maybe, by some miracle, they realised that it is unfair to have limit the claim for general damages to the extent of only 2/3 years to lodge. Let's hope some more good news follows.

The public out there knows very little if anything about their rights as road users. One of the reasons why I think De Broglio is ahead by yards with all the advertising done. People really depend on people who know what to do to "educate" them

Good decision, I hope that the client's doesnt confuse themselves with the 5 years and think that they have five years in which to claim when infact it's 3 years.

Really a good decision made by the High Court. I must say that I would have to agree with your points when it comes to serious injury claims.
