I was surprised to hear that the JSC once again turned down Jeremy Gauntlett. He is one of the great legal minds in our country and represented attorneys when the Road Accident Fund tried to implement direct payments. He is terribly entertaining in Court, perhaps a bit biting and sarcastic at times as he doesn’t suffer fools well, but he is a man with a sharp mind, and there is no doubt, from a legal point of view that he will be an absolute asset to the Bench.
The most common thing you hear amongst attorneys, whenever they talk about him being turned down again (this is the fourth time now) is that it is wonderful for clients, etc that he is not becoming a Judge, because they will be able to continue to have access to his wonderful legal abilities. It is amazing that an advocate who is in such high demand, and is obviously making a fortune, even wants to take the huge reduction in salary that becoming a Judge will entail but I do hope that eventually the JSC will make a non-political decision, and appoint him as a Judge. He is certainly, from an attorney’s perspective, one of the sharpest legal minds at the Bar and if he wants to become a Judge, they should really snap him up.

Unfortunately, Gauntlett is paying the price for competence and independence. News flash: the govenment doesn't want judges who will disagree with them and render rational, sober judgments. The appointment of a chief justice at the Constitutional Court confirms this. Moseneke was a shoe-in for the position until he criticised Zuma. Unfortunately, the government seems intent on taking our courts the way of Zimbabwe with only government lackeys getting positions on the bench.

Its really sad that the very few good lawyers and high profiled position people are being treated this way.
We live in a "Democracy" yet the best is treated like nothing to make provision for people who have a basic clue for what is going on.
dont blame people for leaving this country at times.

He probably ascertained that we are in dire need of "true" and "just" Judges. If you're that brilliant why would you be turned down 4 times - makes you think.

Sadly most decisions with any weight these days are politically motivated. Any high profile position, no matter what it pays, seems to be awarded to the third or fourth best qualified candidate.
It may well be that Jeremy's desire to become a Judge is motivated more by his desire to improve a system that has become lax and shows very little respect for timekeeping when handing down judgments and indeed, for judges trying to settle matters in their chambers quickly rather than running a trial for several days.
