Sentencing now for Oscar

Its sentencing time now in what has really been a long winded trial.  From day one I said Oscar Pistorius would be found guilty of culpable homicide and get 5 to 7 years in jail.  After a long drawn out trial I haven't changed my mind.  The State have asked for 10 years in jail and the Defence have argued that correctional supervision and community service will be enough punishment.

We have have all heard and read the arguments and can make an educated guess as to the verdict - what do you think it will be?

Lets looked at what happened, to be honest the court couldn't find him guilty for murder as they couldn't prove this that there were any intent, but they will have to find him guilty for culpable homicide. I say a minimum of 5 years jail time that will have a 2 year suspended sentence. This will give him about 3 years jail time in total.

I hope he goes to jail that will be justice he killed someone no matter who it is or was he needs to pay for his actions.
Otherwise people will kill more and get away more...

As I have said from the beginning he murdered an innocent woman whether is was on purpose or not he MUST pay for this actions. Cant wait to see what the outcome of this case is.

He must go to jail he murdered someone don't care what people say even if it was an accident or not he has to pay he was the one that pulled the trigger. I think he will get some jail time but he will have it good in jail special privileges.

On a side note; no convicted criminal may gain financially from his crime in terms of South African Law. That is to say, Oscar cannot write a "tell all" book, as he'd be gaining financially from the crime for which he has been convicted.

My initial thought was exactly the same as David's he will have a suspended sentence with house arrest, but after listening to the mitigation factors the past week I am a bit uncertain. I would say if not house arrest then 5 years imprisonment. Everything has already been taken away from him, he will live with it for the rest of his life, what more do they want to take away from him?

I really hope he just gets house arrest. House arrest is as well as Jail. Everything is all ready taken away from him, his whole humanity and he has lost everything why punish him more, Yes he did take someones life. But he needs to live with it for the rest of his life whether now how has a conscious or not. This is my opinion.

I really don't think he will sit in jail for a long time. He will probably get 1 or 2 years. Definitely a suspended sentence. Maybe house arrest and community service.
I agree with Elektra, people will use this case to fall back on in similar situations. Sad really.....

i'll stick with that.
certainly a fine, and possibly correctional supervision - he won't care too much about that.
fact is: he's a first time offender, has shown remorse, is not a danger to society, is not going to do this again, is famous and is not able bodied - will be a target in jail.

Whatever the sentence, be it 1 day I hope he is shown no mercy, he took a life and for that he should be punished.

What a mess our Justice system will become, any one will now use this case as precedent to fall back on and shoot people through doors. Its pathetic.

I am very indecisive, I'd say few months to a year in a prison either that or 1 - 2 years in prison. 7 years suspended sentence. He is most likely after being in prison, go under house arrest. In one of his 'family' members fancy mansion with nice food, luxury, full gym, internet etc! He will have a ball and possibly write that book everyone is speaking about. He will then request that he is allowed to run again and get away with it. To be honest, in South Africa unfortunately even through the court system murderers get away with things like this - even premeditated murder all the time. Oscar is unfortunately famous so people actually care if he sits or not.

Regardless of his reputation i think this case should be treated like any other murder trial. Although I'm sure we all know whatever the verdict is there will be special treatment involved. There are just to many aspects in my mind that make me believe that this was premeditated. I don't think he will go to prison, if he does it will be for a minimal period of time.

i think he will get 1-2 year of actual time in prison but most probably in a special compartment to be away from other prisoners who can potentially harm him.

I think that he will get some time in jail. I think the fact that the trial was so hugely publicised would probably also have some bearing on the decision--taking into account the opinion of society.

I am just reading the comments. I think its disgraceful that he was paying the family of Reeva R6000.00 a month. I think its a bit hypocritical that they now say its "blood money".

Criminal law was certainly not my strong point, but I have to agree with Caron and Cathrine and say that there is a possibility that the sentence may be five years, but that he will not serve the full sentence.

I think that Ashleigh has made an interesting point about Oscar releasing a book after this, perhaps not even for money but an attempt to gain the favour of the public again?

I have to agree, but think it will be closer to 7 years. You cannot treat him any different from your average man on the street and taking all into consideration, house arrest and community service would be disgraceful and cause public outcry. I have to agree with what Caron said though, I think the majority of his sentence will be suspended and his actual jail time will be minimal.

I don't think the Judge is going to bring in a harsh sentence for him. My guess is a suspended sentence or community service.

I can almost guarantee that he will not spend 1 day in jail and that just absolutely angers me. Apparently some prison inmates have already threatened his life and that puts him at risk. If you ask me, he deserves everything that he may get in prison but I do not believe he will even see the inside of a prison cell. Very sad but I believe he will get away without doing any "hard time."

I think he will definitely go to jail. I also wish the death sentence would've been in place for lawful offenders. They can't always get away with it. And money doesn't always make the world go round....

I honestly do not think he is going to do any jail term and if he does, it will be a slap on the wrist in the range of 5yrs, and half of that will be suspended.

In terms of sentencing I am also leaning towards the correctional supervision and community service.
Apart from the sentencing, I would just like to comment, that this trial has become seriously ridiculous! It has become a soap opera! I cannot actually believe Mikey Scholtz and Mark Bachelor made an appearance at court. I actually ended up walking past Mikey Scholtz and it was clear there was an ulterior motive there! I mean even Kenny Kunene made an appearance and the ex girlfriend releasing a book on the same day he was convicted of culpable homicide! Talk about people after the fame!
I am over it.
Whatever the outcome is, so be it!
The Dewani Trial has become far more interesting!

To be honest, I did not follow this trial at all, all i know is that he killed his girlfriend who was in the bathroom and thought she was an intruder and that is about it.. But my opinion is why didn't he ask questions and then shoot,why did he just shoot, you don't know who it is.. He should have asked her then if she was in the Loo..

At present I am leaning towards a suspended sentence, but after hearing Gerrie Nel's closing argument I actually just don't know. His punishment will however be light, of that I am quite sure?

For some reason I think this Judge is going to take a very Liberal approach to the sentencing. Considering the way she has handled the matter this far I think she might go for correctional supervision and community service. She will probably harp on the fact that he is capable of rehabilitation and that prison will not have a positive effect.

I cannot say what it will be but, I am hoping that the state gets the 10 years they have requested. I am one of those who is horrified that Oscar has pulled the disability card when all alone he fought for the right to compete with able-bodied people. He must sit.
