We’ve come across a lot of copycats in the past who, as a result of our media coverage, have tried to piggy back on our advertising. As a result, and because Google is not interested in arguments about who owns what websites in South Africa, they will not act unless you own the trademark, we had to trademark our websites and logo’s. I have written about some of our trademarks before, but the latest trademarks that we have been awarded are for the two hands that appear on our letterhead, our website www.personalinjury.co.za, for our firm’s main website at www.onlinelaw.co.za (we already have a trademark for the website www.accidentclaim.co.za). We have also been awarded a trademark, which prevents anybody else in South Africa, using the phrase “If it is not your fault, it shouldn’t be your problem” in the context of a legal service and the surname “de Broglio” is now trademarked by me in the context of legal firms. I guess it is the nature of the legal business that we always make money out of either people’s misfortune or dishonesty, but trademarks are a clear example of where one takes action basically to prevent dishonesty, because if everybody was honest and carried on reputably in business, you would never have to trademark something, because they would not copy your ideas or websites.

Trademarking is a great preventative method. One must always remember though that we do not exist in isolation, everything around us influences us, who we are, the thoughts we think etc. It isn't right to steal ideas from others and claim them as your own, but everyone uses everyone's ideas and that is life. Can one honestly say, that this idea or slogan that they have, has evolved and manifested itself in complete isolation? We are influenced by others in our everyday choices, in our choices about lifestyle, in our choices about which clothes to wear etc that is why advertising is so effective. I painted for years and copying is the way we were all taught in the beginning. I was obviously never great as I never stole.

i agree with Alexis and Nicolle, people are lazy and not creative . also they do not want to spend money, it is easy to link your name to the name that is well known and spends on advertising and get benefits for free.
they must read Seth Godin's books and get some interesting ideas about creating slogan, adverts, finding clients etc .

I am all for trademarks and patents. If one has an idea, protect it and make it yours. Why let someone else capitalise on your idea when you put the time and effort into coming up with something worthwhile - it is all about ownership.

People are lazy - rather take some one else s idea and make them your own to get ahead in life. It would be wonderful if people just respected each other and instead of leeching off others did their own thing. It takes some time to trademark something, as well as costs a bit of money, but unfortunately it is the world we live in
